What is Workers Compensation?
Every employer must have insurance in case employees get injured on the job. A Workers Compensation case is an insurance claim with your employer’s insurance company. It is not a lawsuit against your employer. This is separate from your group health insurance, which may be provided by your employer.
If you hire me as your Workers Compensation attorney, I will deal directly with your employers insurance company, not your employer.
What do you do when you get injured at work?
The first thing to do is report your injury to your employer. The employer’s first duty is to offer you a Claim Form within 24-hours, offer you medical treatment, and report your claim to the insurance company.
Who will pay for my treatment?
The insurance company is required to pay for 100% of your medical expenses. There are no co-payments and no deductibles. If you have a permanent injury, you have full coverage for the rest of your life.
What if I miss time from work? Will I be compensated?
If your doctor takes you off work for your injury, the insurance company must pay 2/3rds of your gross (before taxes) pay. The insurance company must pay that for up to two years.
How do I know if I need an attorney?
If you are getting your treatment for your work injury and getting your disability benefits, you may not need an attorney. It is time to contact an attorney if the insurance company if not provided medical treatment or your money.
When I get injured, can I see any doctor I want?
Emergency care at any facility is covered. Except for emergency care, the insurance company controls your treatment for the first 30-days. After 30-days, you have the legal right to change doctors. Some insurance companies have a list of approved doctors called a Medical Provider Network (M.P.N.) After 30-days, you can pick any doctor from that list. We can help you select the best doctor for you.
Will I get money to settle my case?
Yes, at the end of your case you will get money based on your level of permanent disability. The more disabled you are, the higher the settlement will be.
